Tom, thank you for your email and for this information.

Under the circumstances, since these things have not yet been worked out, I agree with Tom
that it would be premature to meet with the Board. Perhaps we can do our close out
meeting with the Board on Tuesday, Oct. 27. I will explore that with our staff to see if we
can make time on the Board’s schedule that day to meet with EPA staff. The Board is not
available on Wednesday 10/28.

Kerry and Cynthia, can you be available on Tuesday, 10/27 if we can arrange time with our
Board?

Joanne,

We are having a conference call at 10AM at the USES Public Lands Center (PLC) building
at the Tech center at 10AM. We were going to talk about this at today’s meeting, so I
apologize for the delay in letting you know. The call was contemplated to introduce the
permanent GKM team leadership, ensure closure or transfer of open action items and talk
about the status of Cooperative Agreements and financial issues. Mr. McGrath and or Mr.
Ostrander should be on the call.

The current environmental unit wanted to have an update on the additional analyte testing
we did alongside the EPA at the mine adit. They wanted to work cooperatively on the

release of the information when it becomes available. Their preliminary results are
supposed to be in on Friday, radioactive results are a few weeks out still.

I am planning on being on the call at the PLC Wednesday with the current incident team,
SJBHD, DHSEM, SUIT and others; we should have Admin and Attorney represented as
well.

I believe that having a closeout meeting between the EPA and BOCC would be premature
for this Wednesday. We should ensure that all our needs are either met or addressed with
the new team prior to moving forward with the EPA closure meeting.

Kerry and Cynthia, our Board thought it would be helpful to have a briefing from the EPA
to hear from you about the transition from the incident command structure to whatever the
ongoing approach is going to be. We’d also like to be clear on channels of communication
going forward and the key EPA point persons for issues as they arise. In addition, they
would also like to be briefed on plans for the winter, status of the treatment plant, and any
other updates that you think would be relevant and important for the Board to know at this
time.
